Expert Excursions Ltd Booking Terms and Conditions

Your booking is made subject to the following terms and conditions:

 

1. General

These terms and conditions, together with any other written information brought to your attention before we confirm your booking, shall form the basis of your contract with Expert Excursions Ltd, a company incorporated under the Companies Acts (registered in Scotland number SC645204) and having our registered office at Clyde Offices, 2nd Floor, 28 West George Street, Glasgow, G2 1BP (‘us’, ‘we’ or the ‘Company’) in respect of the relevant tour, shore excursion, or other holiday experience (together referred to in these terms and conditions as ‘tours’) to be provided by the Company. Please read these terms and conditions carefully and contact us if you have any queries.

 

Within these conditions, ‘you’ and ‘your’ means all persons/participants accounted for on the booking. By making a booking, the ‘lead passenger’ or ‘contact’ specified in the booking will be deemed to have accepted these conditions on behalf of all passengers/participants accounted for on the booking whether named or not named. For the avoidance of doubt, ‘written’ or ‘in writing’ shall, where used in these terms and conditions, also include email.

 

We endeavour to ensure that the information and prices on our website and any other media are accurate; however occasionally changes and errors occur and we reserve the right to correct prices and other details in such circumstances. You should check the current price and all other details relating to the arrangements that you wish to book before your booking request is made. All tours are sold subject to availability and are not confirmed until you receive your booking confirmation from us.

 

None of these terms are intended to contravene or contradict the Consumer Rights Act 2015 and your statutory rights under any such legislation are not affected.

3.Booking Process

Bookings can be made via our website at www.expertexcursions.com.

 

Walking Tours
Your booking is not confirmed until we have issued your booking confirmation. At that point a binding contract will be entered into between you and us. Full payment will be required at the time of booking and a booking confirmation will only be issued once we have received full payment from you.

 

Driver-Guided Tours and Shore Excursions
These tours are booked ‘on request’. Please make your booking for these tours as normal. Full payment will be required at the time of booking and a Booking Request Confirmation will only be issued once we have received full payment from you.

 

We will seek to fully confirm your booking as soon as possible and endeavour to do so by email within 3 days of you making the booking. Your booking is not fully confirmed until we have issued a Final Booking Confirmation and provided you with contact details of your guide for your booking. At that point a binding contract will be entered into between you and us.

 

If we are unable to unable to confirm your booking after 3 days we will inform you of this by email. At this point you will then have your choice of either a 100% refund of your payment, or an alternative date for your tour (subject to availability).

 

Your booking confirmation will be issued by email to the contact email address you provide during the booking process. If you do not receive this email for any reason, please contact us at info@expertexcursions.com as it may mean that your order has not been successfully processed. Please also remember to check your spam and junk folders first.

 

Please have your booking confirmation email ready to present to your guide in electronic (for example visible on a mobile phone) or printed format at the start of your tour. The lead passenger’s contact details (name, email address and phone number) will be passed on to your guide to help facilitate any meetings, pick-ups, or other arrangements.

 

4. Cancellation by You

If you wish to cancel your booking after our booking confirmation has been issued, you should inform us in writing by email to info@expertexcursions.com as soon as possible – the effective date of cancellation will be the date upon which we receive such written notification. In the event of cancellation by you, refunds may be issued by us only as set out below.

 

Cancellation of a Half Day (Up to 4 hours duration) Tour:

  • Cancellation 14 or more full days before tour departure: 100% refund.
  • Cancellation less than 14 full days before tour departure: No refund.

 

Cancellation of a Full Day (More than 4 hours duration) Tour:

  • Cancellation 21 or more full days before tour departure: 100% refund.
  • Cancellation less than 21 full days before tour departure: No refund.

 

No refunds are available in the event of you or any of you failing to timeously attend the departure point location of your tour (hereinafter referred to as a “no show”) for any tour. All refunds are refunded directly to the original payment method used to book the tour. Refunds usually take 3-5 business days to reach your account from when they are issued by us.

 

 

 

5. Cancellation by Us

We will only cancel tours due to circumstances which are outwith our or our supplier’s control or which might jeopardise your safety. If we or our suppliers cancel your tour then we will notify you as soon as possible and we will always refund you, in full, for all sums paid by you for the tour. In that event, we shall have no further liability to you.

 

6. Tour Timings

Please note that return times stated are estimated. Due to the unpredictable nature of travel, we cannot guarantee these times. Please bear this in mind when arranging any further travel connections or activities. Expert Excursions are not responsible for missed travel connections or activities. We strongly advise procuring travel insurance to cover any unfortunate events where you are unable to reach connecting travel or other arrangements.

 

For Shore Excursions: Please note that return times stated are estimated. Due to the unpredictable nature of travel, we cannot guarantee these times. In the case of any unpredicted events arising during your shore excursion, every reasonable effort will be made to return you to your ship in time for its departure where possible. This may involve prioritising your return over other parts of your itinerary. In that event, we shall not be required to reimburse any part of the payment received from you.

 

Expert Excursions sells tours as individual products and not packages. If, after selecting and paying for one travel service, you book additional travel services for your trip or holiday via the Company, you will not benefit from rights applying to packages under the Package Travel and Linked Travel Arrangements Regulations 2018 (“the 2018 Regulations”). You are required to ensure sufficient time is left between tours.

 

7. Insurance and Disclaimers

Our tourist guides are independent, self-employed tourist guides and are not our employees. We therefore have no liability for any acts, omissions, errors, representations, warranties, breaches, negligence, personal injuries, death, property damage, or other damages or expenses on their part.

 

However, as part of your booking we ensure that they carry their own insurance. You can if you wish request us to provide you with their insurance details.

 

Expert Excursions strongly recommends that passengers on our tours arrange for themselves suitable travel, medical and cancellation insurance in advance.

 

8. Changes by Us

While Expert Excursions and our suppliers shall do everything reasonably possible to provide your tour itinerary and/or services as planned, the Company reserves the right to alter itineraries, or transport if required to do so. We shall make reasonable endeavours to provide that the majority of any such alterations will be minor and we will try to advise you of them at the earliest possible date.

 

In the event, however, that we are required to significantly alter a material part of your tour, we will notify you of this as quickly as possible in order to enable you to decide how you wish to proceed. In such event you will be entitled:

 

1. to take the tour with the alterations

2. to take an alternative tour of equivalent price, if we are able to offer that, or

3. to take a substitute tour of lower price, if we are able to offer that (in which event the difference in price between the original and the substitute tour will be refunded to you); or

4. to take a substitute tour of higher price, if we are able to offer that (in which event the difference in price between the original and the substitute tour will be payable by you); or

5. to cancel your booking and obtain a full refund of all monies paid by you.

Please be aware that the nature of travel involves risks, unpredictable weather, and unpredictable road and traffic conditions and we cannot, therefore, guarantee any departure or arrival times or visits to attractions at any particular points of a tour itinerary.

 

9. Changes by You

If you wish to change any part of your confirmed booking, you should inform us in writing by email to info@expertexcursions.com as soon as possible. This should be done by the lead passenger / contact named on the booking. Whilst we will do our best to assist you, we cannot guarantee that we will be able to meet your request.

 

Where we can meet a change request made by you, you may be required to meet any extra costs incurred by us (and any costs or charges incurred or imposed by any of our suppliers) in making the requested change. Where we are unable to meet your change request and you no longer wish to travel on the basis of the original booking, this will be treated as a cancellation of your booking and cancellation charges may be incurred by you, as outlined in section 4 of these terms.

 

If, once your booking is confirmed, you are unable to travel for any reason then we will allow you to transfer your booking to someone else (introduced by you, and who satisfies all of the conditions applicable to the booking) provided that:-

 

1. we are notified of this in writing at least 5 days prior to departure;

2. you and/or the transferee make payment of any additional costs and charges incurred by us and/or imposed by our suppliers, and

3. the transferee agrees to these conditions and all other terms of the contract between us.

 

For the avoidance of doubt, no transfer requests or changes will be finally confirmed until full payment of any applicable charges referred to above have been received by the Company.

 

10. Late and Missed Departures

If you are late for the start/departure of your tour, we cannot guarantee that your guide will be able to extend your tour to make up lost time. In these cases the guide will attempt to deliver as much of the tour as is reasonably possible to conclude the tour within the time remaining.

 

You are responsible for ensuring that you are at the correct departure point for the tour at the correct time. We cannot accept any responsibility for your failure to do so, nor any costs or expenses incurred as a result of you failing to do so (which will be treated as a cancellation by you). No monies will be refunded for any unused services or a ‘no show’.

 

11. Other Operators/Carriers/Third Party Suppliers

Many of the aspects of your tour are provided by independent suppliers, who provide such products and services on the basis of their own terms and conditions. In particular, tickets for travel on other carriers are subject to the normal conditions of carriage of the individual carrier. The Company may share your personal information with other carriers or venues insofar as necessary to enable products and services to be provided. Further details of this can be found in the Company’s Privacy Policy referred to in section 16.

 

Although we will use reasonable skill and care in verifying descriptions and other information provided by third party suppliers, we cannot guarantee that all such information is accurate, complete or correct and we have  no responsibility or liability for the accuracy, completeness and correctness of the information provided to us or you by each supplier and / or for the acts or omissions of each supplier. For the avoidance of doubt you remain responsible for payment of all sums payable to third party suppliers unless stated otherwise. This does not, however, affect your statutory rights under the 2018 Regulations, if applicable to your booking.

 

If we are found liable to pay you compensation, then (subject to the following paragraphs) the maximum amount which we will be liable to pay to you in respect of any claim shall be limited to the price paid to the Company for your booking, in total. This limitation shall not apply to any claims relating to death or personal injury or fraud or negligence (or any other type of claim that cannot be excluded or limited at law). You must notify us of any potential claims under this provision at the earliest opportunity.

 

The Company shall not be liable for unforeseeable or indirect losses. We will not be responsible for, nor will we be liable to pay compensation for, any loss, cost, damage or claim to the extent that it results from:

 

1. any act and/or omission by you;

2. the act or omission of any third party unconnected with the provision of the services contracted for and which were unforeseeable or unavoidable;

3. unusual or unforeseeable circumstances beyond our (or our suppliers’) control, the consequences of which could not have been avoided even if all due care had been taken; or

4. any event which either we or our suppliers could not, even with all due care, have foreseen or forestalled.

The Company cannot assume responsibility for any costs incurred for any travel or other arrangements purchased separately from the Company.

 

12. Luggage on Driver-Guided Tours and Shore Excursions

Should you wish to bring any luggage with you on our Driver Guided Tours and Shore Excursions, to ensure your comfort this should preferably be airline carry–on size or smaller per person.

 

If you need to bring more luggage or any luggage larger than described above with you on your tour, please indicate this to us at the time of booking in the box titled “Please tell us about any requests or requirements you may have for this tour” so that we can make any necessary arrangements required.

Luggage is carried at the passenger’s own risk. It is the passenger’s responsibility to ensure that luggage is fit for travel.

 

13. Prices

The items and services included and not included on each tour are listed on each tour listing page on our website. Before booking please check all inclusions and exclusions of the tour.

 

14. Customer Conduct and Refusal of Travel

Smoking is not permitted on board any tour vehicle.  The Company reserves the right to refuse to carry any person whose conduct or manner is likely to cause offence or upset to other passengers. In this event there will be no refund of any monies paid by you to us.

 

15. Force Majeure

Unless expressly stated otherwise in these terms and conditions, we will not have any liability to you if we are prevented from fulfilling our contractual obligations to you as a result of any event which is outwith our control (and/or outwith the control of the supplier or provider of the service in question). Such events may include (but are not limited to) war or threat of war; terrorist activity or the threat of terrorist activity; civil commotion or riot; any action taken by a governmental or public authority; industrial disputes; collapse of buildings, fire, explosion or accident; traffic conditions; road and walkway conditions or closures; technical or mechanical breakdown; adverse weather conditions; natural disasters; epidemic or pandemic, fuel or energy shortages, power surge or failure, and all similar events or circumstances.

 

16. Data Protection

We take your privacy seriously and will always endeavour to process your personal information in accordance with applicable data protection laws. In order to process your booking and to ensure that your travel arrangements run smoothly, we will need to use the personal information which you provide to us (such as your name, address, contact details, any special requirements etc). Where you have consented, we may also use the information provided to keep in touch with you and to advise you of the Company’s products and services (including special offers) from time to time. We may also pass personal information on to third parties (such as suppliers relevant to your booking) where necessary and where appropriate measures are in place. We will not, however, pass your information on to anyone who is not involved in providing (or arranging the provision of) any product or service related to your booking. By making your booking you consent to these arrangements and those set out in our Privacy Policy and Cookies Policy.

17. Tour Participants

The lead passenger (also referred to as the Contact) of the booking must be at least 18 years old at time of booking. All children must be accompanied by an adult aged at least 18 years. While there is no minimum age for guests on our tours, we do ask customers to bear in mind that walking tours can involve long periods of walking and that driver-guided tours and shore excursions involve long days.

 

As a legal requirement, children who are both under the age of 12 and under 135cm/4ft 5in tall will need a child car seat on our driver guided and shore excursion tours. If anyone in your group requires any child car seats for your tour with us you must indicate the number of seats you will require for this tour during the booking process. This will enable us to provide the correct seats for your tour. Without this equipment your tour may not be able to depart. The maximum number of child car seats we are able to provide per tour is two, unless otherwise arranged and agreed in writing with us prior to you making your booking.

 

For your comfort, safety, and enjoyment of our tours the total maximum group size (number of passengers) you can book and can travel on to our tours is no more than six on driver-guided tours and shore excursions, and no more than 10 on walking tours. Please select the appropriate number of passengers in your group when making your booking.

 

18. Payment

Full payment by credit or debit card is required to make a booking. We accept Visa, MasterCard, and American Express cards. Your bank or payment card company may convert the payment into the local currency and may charge fees, resulting in differences between the amount displayed on our site, and the final amount charged to you. We recommend that you contact your bank or card company if you have any questions concerning any applicable currency conversion or fees.

 

We use a third- party payment processor to process your payments for the services. By buying from Expert Excursions you authorize us to disclose your information and payment instructions to the payment processor and agree to be bound by the current version of processor’s privacy policy and terms of service. Our current payment processor is Stripe.com via Fareharbor.

 

19. Pricing

The price of each tour will be quoted on a per-group basis, unless otherwise specified. Prices are based on the local tariff at the time of quoting, and may be converted at the prevailing foreign-exchange rate as determined by us. Price quotations are subject to change without notice, until a Booking has been made. Prices do not include insurance or any beverages, food, or other extras that we have not specifically stated are included.

 

 

20. Currency Conversions

If we provide a currency converter, currency rates are based on various publicly available sources and should be used as guidelines only. Rates are not verified, and actual rates may vary. Currency quotes may not be updated on a daily basis, and we do not guarantee accuracy. We shall not be liable to you if prices change due to currency fluctuations.

 

21. Booking Engine

We use third-party software provided by Fareharbor to process all bookings made with us. By making a booking with us, you also agree to their Policies and Terms.

 

22. Complaints

We actively welcome your feedback, both in respect of our own services and those provided by other suppliers (such as venues and attractions). In the event that you have any complaint during the course of your tour then please bring this to the attention of your guide as soon as possible, and we will endeavour to resolve the matter to your reasonable satisfaction.

 

If your complaint is not resolved locally and you wish to complain further then please contact us at info@expertexcursions.com providing all relevant information necessary to enable us to consider your complaint. We would request that any complaints be raised with us within 28 days of the end of your tour, as otherwise our ability to investigate the complaint properly may be affected.

 

23. Special Requests

Any special requests should be advised to us at the time of booking. Whilst we will try to accommodate your reasonable special requests, we cannot guarantee that they will be fulfilled and failure to meet any special request will not be a breach of contract on our part.

 

24. Disabilities and Medical Conditions

We will try to accommodate disabilities and medical conditions where we can but please be aware that many of our tours may not be suitable for persons with particular conditions. If you or any member of your party has any disability or medical condition which may affect their ability to travel on our tour then please provide us with full details at the time of making your booking, in the box titled “Please tell us about any requests or requirements you may have for this tour” on the Booking Questions page so that we can advise you as to the suitability of your chosen arrangements. If we are not informed of any disabilities or medical conditions in this way then we cannot be held responsible for any cost, inconvenience, or inability to provide service incurred if we are unable to accommodate you or any member of your party.

 

For tours which are booked on request (driver-guided tours and shore excursions): If, acting reasonably, we are unable to accommodate the needs of the person(s) concerned then we will not confirm your booking or (if you did not give us details of the disability or medical condition at the time of making the booking request) we shall be entitled to cancel your complete booking and to levy the relevant cancellation charges.

 

For tours booked instantly (walking tours): If, acting reasonably, we are unable to accommodate the needs of the person(s) concerned if you did not give us details of the disability or medical condition at the time of making the booking, we shall be entitled to cancel your complete booking and to levy the relevant cancellation charges.

 

25. Website Links

Where our websites contain links to other sites and resources provided by third parties, these links are provided for your information only. Such links should not be interpreted as approval by us of those linked websites or of any information you may obtain from them.

 

26. Enforceability of Terms
If any provision of these terms and conditions is found to be illegal or unenforceable, that shall not affect the validity and enforceability of the remainder of these terms and conditions.

 

27. Contract (Third Party Rights) (Scotland) Act 2017

These Terms and Conditions do not create any rights in favour of third parties under the Contract (Third Party Rights) (Scotland) Act 2017 to enforce or otherwise invoke any provision of these Terms and Conditions.

 

28. Governing Law and Jurisdiction

To the extent permitted by law, these terms and conditions shall be governed by and construed in accordance with Scots law and any matter or claim arising from them shall be dealt with only by the Scottish courts.
